The Goa government has filed a petition in the Bombay High Court against the acquittal of former Tehelka magazine editor Tarun Tejpal of rape charges. The government has appealed to the court to hear the case again. In the petition, the government has argued for the lack of understanding of the court regarding the trauma suffered by the victim after the judgment of the sessions court and questioning her character.

The government says that the evidence presented by the defense counsel not only accepted the truth as true, but also ignored the evidence of the victim and the witnesses of the prosecutor. The government claimed that the court completely ignored even the most important fact in the matter (apology e-mail). It clearly shows the guilt of the accused.

On May 21, the sessions court acquitted
On May 21, Sessions Judge Kshama Joshi acquitted Tarun Tejpal. He was accused of sexual harassment of a female colleague in the lift of a five star hotel in November 2013. The appeal, filed before the Goa Bench of the High Court, was amended this week to incorporate aspects of the trial court’s judgment and arguments against Tejpal’s acquittal.

Appeal to remove certain facts from the court


The Goa government has appealed against this decision. The prosecutor, in an appeal filed in the High Court, has sought removal of those portions of the trial court’s decision which impute not only the prosecution but also the victim. The prosecution said that this fact and other aspects make it clear that the case should be re-examined as per law.

This case was going on in the Sessions Court of Mapusa, Goa. Additional judge Kshama Joshi had reserved the verdict last month in this 7-and-a-half-year-old case. At the behest of Tejpal, the case was heard in closed rooms. In this case, Special Public Prosecutor Francisco Tavora presented the side of Goa Police. On the other hand, advocates Rajiv Gomez and Aamir Khan represented Tejpal in the court.

First 3 times the decision was postponed
The court was to pronounce its verdict on April 27 in the rape case against Tejpal. Judge Kshama Joshi postponed it till May 12. Then in the hearing held on May 12, the date of May 19 was given for the decision. After this, again postponing it for 2 days, asked to pronounce the verdict on 21 May. The court cited the lack of staff due to the Corona epidemic behind it.

was arrested in 2013
Tejpal was arrested on 30 November 2013 after being accused of rape. Earlier, he had also appealed for anticipatory bail, but the court refused to grant him any relief. Tejpal was granted bail in May 2014.
